Como são vistas as fotos de Sally Mann


O New York Times traz neste domingo matéria de Sally Mann, que vinte anos atrás publicou o livro "Immediate Family" com fotos das suas crianças, as vezes peladas. O título é "A exposição de Sally Mann: o que uma artista capta, o que uma mãe sabe e o que o público vê pode ser coisas perigosamente diferentes.

O análise da Mann não é jurídica, mas artística e filosófica: quer dizer, mais profundo do que é comum neste assunto. Que não quer dizer que ela desprezou o lado legal - entendeu, e foi além. Em busca de orientações décadas atrás, procurou o FBI e foi lá com o marido e os filhos, para falar com o agente Kenneth Lanning. Já conheço o nome de Lanning, que foi um daqueles que acabou com o febre de "abuso ritual satânico" de escolinhas lá nos EUA.

A foto não é a pessoa

No lado filosófico, Mann explica a velha regra de que a mapa não é o território:

O fato é que estes não são os meus filhos; eles são figuras em papel prateado pinçadas fora do tempo. Eles representam os meus filhos em uma fração de segundo em uma tarde específico com infinitas variáveis ​​de luz, expressão, postura, tensão muscular, estado de espírito, vento e sombra. Estes não são de fato os meus filhos; estas são as crianças de uma fotografia.

Até as próprias crianças entenderam essa distinção. Uma vez, Jessie, que foi de 9 ou 10 anos na época, estava experimentando vestidos para vestir a uma vernissage numa galeria em Novo Iorque das fotos de família. Era primavera, e um vestido era sem mangas. Quando Jessie levantou os braços, ela percebeu que o peito era visível através das cavas grandes para os braços. Ela jogou o vestido de lado, e uma amiga comentou com alguma perplexidade: "Jessie, eu não entendo. Por que diabos você se importa se alguém pode ver o seu peito através das cavas quando você vai estar em uma sala com um monte de fotos que mostram que mesmo peito nu? "

Jessie foi igualmente perplexo com a reação da amiga: "Sim, mas aquilo não é o meu peito. Aquelas são fotografias."

Além do superficial

Mann reclama que vários críticos confundem o papel de fotógrafa com a papel de mãe. Ela revisita o controvérsia de ambas destas perspectivas, e de outros.

Em contraste, as críticas com que o livro foi recebido faz vinte anos, parecem superficiais. Não captam a distinção entre pessoa e imagem que até Jesse Mann já entendeu com nove anos.

Partem da pressuposição de que não há nada mais invasiva do que a exposição da pele. Porém, tudo mundo tem um pele, e na pré-adolescência, os peles seguem um padrão (ou dois padrões) bastante, bem, padronizadas. Já notamos gente rica expondo nudez dos filhos ou até as própria fotos de infância, sem preocupação e sem consequências.

Além da visão legal

Há uma ideologia entre advogados, promotores, etc. de que quem não adota a visão jurídica, "não entende" do assunto ou da lei. É possível entender e discordar, até por entende o assunto melhor. Mann entende, e entende melhor que as críticas, e melhor que a comunidade jurídica. A matéria compensa muito a leitura.

Arrested for nudist films?

Thursday the Canadian police announced "Project Spade" and the arrest of 348 people for purchasing DVDs from the site Azov Films: DVDs that were advertised as legal nudist films. Last week, a father living at the Sunsport Gardens nudist community was arrested because he had hired a professional photographer to take "family photos" of his daughters, and unknown to the father or the girls, the photographer either cropped some photos or else zoomed the lens in on the girls' crotches.

On the Azov Films case, the Canadian police said:

“This case has really challenged people to reconsider what nudism and child modelling are. It’s caused countries around the world to look at this material and ask whether it’s OK for doctors, teachers, daycare providers and hockey coaches to be buying this kind of material.”

Nature of Azov Films DVDs

According to the Toronto Star,

On the surface, it appeared to be a legal “naturist” site, showcasing what were billed as artistic films that featured nude boys. But officers decided a closer look was needed, and an investigation was launched in 2006. They looked at Way’s material and found nudity — worrying to many, but not enough to meet the strict legal parameters of child pornography.

However (according to the news articles) the owner of Azov Films, a Mr. Way, also had his own private collection of unmistakable child pornography. The news coverage alternates references to the personal porn collection, or non-Azov pornography found with Azov's customers, with statements about the films sold on the site during the six years it was in operation, from 2005-2011. Possibly in the expectation that careless journalists would confuse one with the other, as some have indeed done.

While Azov's site was taken offline when the owner was arrested in mid-2011, the Internet Archive holds the company's own description of the material it sold and in some cases produced:

  • Our naturist/nudist films are of authentic naturism and are not obscene, lewd, sexually oriented, lascivious, or pornographic. They are not illegal to own, sell or distribute. Our naturist films are suitable for viewing by all family members.
  • We have no pornography, obscene material, lewd material, lascivious exhibition of the genitals, prurient conduct, vulgarity, or close-ups of body parts in our naturist films.

The films were openly for sale via the Internet, and delivered by the Post Office. Azov was in court in the US several times over the years - battling over trademark and copyright questions. Apparently there is case law that customers cannot use as a defense the company's own description of the legality of the material. Even so, as the site operated for many years without government interference, and the police seem to have carefully avoided saying that what Azov sold was pornography, it seems likely that simple nudity was all that was sold via the website.

"Child exploitation" is how the police describe the DVDs for sale. But what does that mean? Belanger is quoted by the Star: “One child in a movie takes 15 showers — all these kids we knew were being exploited.” In comparison, in the Brazilian film "O Menino Maluquinho", the pre-teen protagonist takes a bath, with a pet turtle, in front of the maid. In "Pixote", the title character takes a shower, and again the camera shows all. "Exploitation", and we never knew it!

The police say that the DVDs of the boys are "explicit", but they don't say that they are "sexually explicit". Nudist films can indeed show "explicit" nudity (which is not illegal), without showing explicit sex. The vocabulary games remind me a story of the era of "yellow journalism": a woman was described as "exotic" because the paper could be sued for "erotic", and why not? its readers didn't know the difference.

For our Brazilian readers, the DVDs that resulted in the arrests seem indistinguishable from the DVDs sold by "Brasil Naturista" (also known as "pelados.com.br") and before it, the VHS tapes sold by the now bankrupt Naturis. And no different from the films made of rented children - sorry, hired models - at Abrico Beach in Rio and at several other Brazilian naturist venues around 2009, still for sale on sites indistinguishable from that of Azov Films.

Naturists beware

The contrast between the carelessly worded press accounts, and the weasel-worded police phasing, makes it quite clear that the material Azov sold via its website was close to the line between naturist photography and child pornography. Inspector Belanger's summer of watching movies found that under a third of the films crossed the line. Since Mr. Way claimed to have known the law, and conducted his business openly, it seems likely that the third, even if over the line, were not far over it.

How can a naturist be sure that he has family pictures, and not child pornography? The answer seems to be, he can't. We'll return to that question later.

Carnaval, Children, and Naturism

Carnaval, like soccer, is an Brazilian obsession. Some people live and breathe Carnaval, preparing all year round for five nights of dancing, or an hour's parade. And despite the sensuality of Carvaval, childern grow up involved. Does children's participation in Carnaval differ from their participation in naturism?

"Over the harsh nudity of truth, the diaphanous robe of fantasy" is the subtitle of Eça de Queiroz's "The Relic", and part of the theme of this year's parade of the Imperatiz Leopoldina samba school in Rio de Janeiro. The celebrated phrase can be taken to describe the difference the exiguous costumes of Carnaval make.

What is Carnaval?

The public spectacle of the Carnaval parade in Rio de Janeiro, and its lesser cousins elsewhere, is the face of Carnaval most visible to foreigners. But many cities still have street carnavals, where people dance in agglomerations of greater or lesser organization, a traditional activity that is making a comeback in recent years. And there are closed balls, the televising of which in the early 1980s provoked complaints from the then-president of the Republic. So which Carnaval are we talking about?

The Parades

The parades are a competitive activity, where a fraction of a point can move a "school" - the group that organizes a parade of an hour or so - up to a more prestigious class of schools, or downwards into the bush leagues. Some of these groups are organized by neighborhood, and in São Paulo many are associated with soccer teams, the fans of which can be fanatically loyal and involved.

During this year's Carnaval in the port city of Santos in São Paulo, a Carnaval float that had just finished the parade escaped its handlers and crashed into a power pole, electrocuting four people and bursting into flames, at about 1:30 in the morning. Among those aboard the float during the parade were 22 children, who were saved by having climbed off ahead of schedule, 75 feet before the accident. TV network Globo spoke with one eight-year-old who said, "God protected me." The school is linked to the Santos soccer team, and the boys on the float were dressed in soccer uniforms.

Inherent physical danger

A Carnaval parade is inherently dangerous. Because of the competitive nature of the event schools are driven each year to try out new and more spectacular effects. A school will put on its parade exactly once, except for the champions of each category, who parade again the following week. There is no full dress rehearsal. The labor is amateur or poorly paid - those who died pushing the float in Santos were paid US$20 for the night. The schools are precariously financed, traditionally by people on the fringes of the law. And of course it's often the middle of the night.

So why do children participate? Because they're part of it. If there are no young sambistas, there will be no middle-aged and then no old ones. A children's wing is usual, and many of those in the drum section are in their teens, at least here in my neighborhood.

The nationally and internationally televised Rio de Janeiro parade is one extreme of Brazil's Carnaval. A browse though Web sites finds this photo gallery of the "Indian tribes" in the Northeast city of Natal, where a heavy presence of children and adolescents is visible (or at least they were the ones who attracted the photographer's eye).  In the city of Recife, where there are also "Indian" groups, this site tells us:

In the midst of each presentation, a mixture of generations forms the identity of each caboclo group. Sílvio Romero, known as Little Silvio, explains that the teachings are passed down from generation to generation. He, who has three children, takes pride in being able to continue the habit inherited from his father. "The Tapuias Chamber of Camaragibe, which I coordinate, is already on its way to the fourth generation. My father, José Boaventura Borges, was part of the Kapinawá Native Tribe".

But can't it be made more child-friendly? Well, the parade takes place at night because many of the effects show up better then: it's easier to make magic. Also, we're in the tropics here, and in the middle of the summer. It's not possible to air-condition an avenue. But it is cooler at night.

The parade does have elements of danger. So does dancing in the streets; there have been incidents with power lines and electrocutions there, too. This year the brakes on a sound truck failed on a hill, and a child was crushed. Children in the US play "American football" and ride bicycles despite the danger.

Inherent moral danger?

The question of moral danger to children is, oddly, touchier than that of physical danger. Here Carnaval and naturism com closer, as naturism carries no special physical danger to children except perhaps the chance for more pervasive sunburns. Skinned knees are just as possible in shorts.

A lot of the women in the Carnaval parade wear very little. That is rather the point. Bare breasts, whether by design or by accident, are taken in stride. This text from rio-carnaval.net explains:

"Even though total nudity is nor officially permitted, sometimes the floats have beauties who are topless or almost nude, men and women, using only body paint, and lot of glitter and a smile."

Could the children parade far from the more "adult" costumes? Perhaps, but the school assembles all together before entering the avenue, and the area of the "dispersion" brings together people removing very elaborate costumes, and those covering up near nudity. The atmosphere can apparently be odd, with the release of the tension of performance, and as people stop being characters and once again are friends and neighbors. And children.

Besides the costume, there is the question of performance. Those on floats gyrate and wave, but those on the street, samba. Sensuality is the goal, and it's achieved. But often a drum section will have a "junior queen". Certainly a mascot rather than a sex object, and wearing a much more substantial costume than her older counterpart (what's the point of baring a chest without breasts?) but she too sambas.

And the balls?

While the parades are for looking at, the Carnaval balls are for getting close to someone. There's a stricter age segregation. A samba school parade may include eight-year-olds, but a ball won't. There are separate "matinees" for kids, where costumes will be your more standard pirates and clowns and such. Brazil doesn't have Halloween, Carnaval is the big chance for children of all ages to dress up - as well as the chance for adults to dress down.

Carnaval balls have long been portrayed as a sort of one-night Sodom and Gomorrah, in many senses: the leading paper Folha de S. Paulo illustrated its social column the Friday of Carnaval with a photo of a transvestite. Once upon a time, an admission ticket was good for one man - and two women.

Waiting for developments in the Colina do Sol case, I languished one Carnaval in Taquara, Rio Grande do Sul. I didn't go to the ball at the traditional Clube Commercial, though I did notice that the Junior Queen's last name was the same as graces half-a-dozen of the larger establishments in town. The ball was crippled by restrictions imposed by the Prosecutors' Office barring adolescents; the last night was cancelled and tickets refunded. But the parade down the main street included teens who were some of the more uninhibited performers, and on the sidewalk I saw a number of teenagers drinking heavily, swigging vodka straight from a bottle.

Why include children?

Carnaval and soccer are Brazilian national obsessions which have a heavy involvement of youth. Not every boy is going to be a professional soccer star, and not every girl is going to the Muse of the Percussion Section. But there are soccer fields where anyone can play for enjoyment into middle age or older, and there is joy in being one of the dozens or hundreds who move in unison in one of the enormous blocks on the floor of the Sambódromo, between the floats. And there are plenty of other places to dance.

The samba schools, the Carnaval "Indian tribes" important in some regions, and the less structured groups see themselves as communities. They have stalwarts who keep the group running from year to year. Many of them have special sections for "veterans", who perhaps cannot stay light on their feet for an hour down the avenue, but have done much in the past, and for whom an honored place is found. They have wings where less precise dancing is needed, in which they sell places and overpriced costumes to tourists, to subsidize those who bring dance and dedication but no money.

And they have have children's wings, and child queens, and wings and tasks for adolescents, or as seen in the "Indian" photo gallery linked above, children and adolescents are mixed in with their parents, relatives and neighbors. For without the young, they will soon have only the old, and the traditions will die.

And children in naturism?

It would be astonishing to see a Brazilian naturist group with the same proportion of children as in the galley of pictures of the Natal "Indian" tribes above, or the number I see if in the months before Carnaval I follow the sound of the drums of the neighborhood samba school or even the proportion of children you see at Sunday Mass.

Opposition by prosecutors and others to the participation of children in Carnaval is sporadic and circumscribed. Banning those under 18 from balls that aren't special matinees is not uncommon. A news search finds that specific permission for an eight-year-old to act as "junior queen" of a percussion section in a Rio samba school. But no such permission was asked for the dozens or hundreds of other children who took part in the same celebration.

Why is the presence of children widespread and officially tolerated in the sensual hothouse of a samba school, but such a lighting-rod for police, prosecutors and family court judges in naturism? We'll loot today at one factor: why are the attacks on children's presence made? We may in the future come back to another issue, which is why do Brazilian naturists, individually and as a group, make no attempt to defend against such attacks?

Looking at the special treatment prosecutors dispense to Carnaval balls, we see that an event that takes place at a specified time in a specified place makes it easy to issue and enforce a ban. You go to the Club Commercial or the Praia do Pinho, you see if there are children or unaccompanied children, and if you find them you threaten someone with legal consequences. In contrast, not only is it difficult to police adolescents drinking on the street, but if you catch them - who do you punish? Who can be threatened with a loss of an operating license, or a punitive prosecution?

A samba school is many things: a public exhibition, a community event, a family tradition, an artistic creation. A Carnaval ball can have some of those elements - as in the once highly competitive costume competitions - but the overwhelming purpose is hedonistic.

Women on Brazilian beaches may wear almost nothing, but they do have if not "the diaphanous robe of fantasy", then at least the concealment of a bikini so diminutive that only "Brazilian waxing" lets it cover pubic hair. From the rear it's possible to buy two bikinis and between them get an all-over tan, suggesting that it's not important than anything specific be covered, but only that something be.

Looking at two specific prosecutorial bans on children and nudism, serves only to show us once again "Over the harsh nudity of truth, the diaphanous robe of fantasy":

In late 2010, the former president of SONATA, the group that manages the Tambaba naturist beach in the northeast state of Paraíba was arrested, supposedly for child pornography.

  • The "evidence" displayed at a press conference included pictures of the man and his naturist family, defaced with black bars - except for his youngest daughter, who prosecutors displayed to the media fully nude. Very odd.
  • Part of the follow-up was an announcement to the media that children would no longer be permitted on the beach. What we've heard here is that the ban in not in fact enforced - it was merely announced.
  • Another effect was a decree by the local mayor cutting the size of the designated nude beach by two thirds; a "pharonic" resort development is being pushed for the environmental protection area behind the beach. Reducing the size of the nude beach was essential to making the resort viable, and the arrest may have been merely to provide a pretext.

In 2007, four naturists, including the president of the Brazilian Federation of Naturism, were arrested at or near the Colina do Sol nudist colony in southern Brazil:

  • Several accusations were for the creation of child pornography; nothing questionable with the supposed victims ever appeared in over 5,000 pages of legal documents;
  • The supposed victims, all in or almost in their teens, denied any abuse (except one, but he lies, as I've documented elsewhere);
  • Meanwhile, nude photos of children taken in the nudist camp, something specifically banned in a consent decree signed with the prosecutors office, appeared in nudist magazines, and even in local general-circulation newspapers;
  • Prosecutors took no action against those in clear violation of the consent decree, neither the child's father (also the club president) nor the publisher, perhaps because the testimony of the guilty, was the only evidence prosecutors had against the four innocents they'd arrested.

In these two cases, the posturing of prosecutors serve to let them appear in the press - and in fact, naturism gets press coverage far in excess of the actual number of people involved. It's great as a megaphone. But in neither case were the announced bans and consent decrees, actually enforced.

Naturismo e Pornografia

Entende-se por pornografia a forma como os indivíduos enxergam as coisas naturais e não as próprias coisas naturais como são.

Então se fosse como a maioria alega que pornografia está diretamente ligada ao nudismo todo o ser humano (bebê) já nasce pornográfico o que não é assim. Toda a vida existente no planeta seria pornográfica pois tanto os vegetais como os animais não cobrem a sua nudez natural para ter moral, não precisam desse artificio.

Entendo que a pornografia foi criada e cultivada pelas religiões e seitas e pelas leis absurdas do homem. Para os religiosos diz na bíblia sagrada que para um indivíduo ter seu lugar grantido lá nos céus tem de ser como as criancinhas com sua inocência, o que entendo ser, a nudez das malícias da mente criadas pelo próprio homem. É por isso que divido bem essas duas coisas, nudismo e naturismo.

Nudismo é para mim o simples fato de estar sem roupas e viver assim, o que também não é errado, e naturismo é viver exatamente de acôrdo com a naturalidade do natural, como fomos fabricados e prontos para esta natureza. 

A mente das pessoas está tão doente que já nem enxergam mais o natural das coisas, só vêem o que o homem criou, as fantasias, tecnologias, e tudo o que somente querem ver, tendo vergonha do que é natural e real porque é nu e cru sem artifícios, na natureza não existem padrões de beleza melhores do que a forma de como foram criados. Por isso temos a beleza das florestas nas suas diversidades, nos jardins com todas as suas cores, nos animais com o seu amôr divino e em tudo o que Deus criou, o homem com toda sua inteligência conseguiu destruir tudo isso apenas com seus atos e pensamentos.

O Homem criou um deus falso em suas mentes, atrofiando em muito o seu cérebro, um deus que se envergonha de sua propria criação, um deus que coloca o respeito apenas nos adornos que escondem a naturalidade da criação, tudo isso devido à sua debilidade mental. 

O Homem também criou leis e normas de conduta onde passou a ser natural e aceito como natural as próprias atrocidades e destruição da natureza seifando vidas, não admitindo sequer a naturalidade e os direitos humanos da existência de cada ser. Se alguém tivesse que ser encostado em um paredão seriam esses covardes que não tem a mínima capacidade de ser e existir, criar leis absurdas obrigando todos a se apodrecerem junto com eles. Não sou obrigado a ter uma mente podre e doente igual a maioria embora tenho que ter medo dessa gente, pois é muito perigosa, são verdadeiros assassinos a sangue frio. Que o verdadeiro Deus tenha piedade dessa pobre civilização.

A pornografia como justificativa

O naturismo é o meio. Os interesses vão emergir.
Há duas coisas que me impressionam. A primeira é um censura informal que contraria disposições constitucionais que proíbem a censura. A segunda é o prestígio legalista da justiça brasileira sendo jogada para o alto em face de leis mal feitas e juízes mal preparados intelectual e profissionalmente que se guiam pelo clamor de grupos, tomando decisões valorativas e não jurídicas.
Loucos são aqueles que pensam diferente de mim. Louco é o Rones, um perigo à comunidade, porque pensa diferente do juiz que o interrogou, mergulhado em noções morais, distante de fatos concretos. Pior: dando pareceres que não são da sua alçada, da sua competência. Rones é louco por diz que andar nu ou ser naturista – não é crime. E por isto foi internado num Gulag paraibano. Soljenitsin continua atual.

Sobre pornografia Fabiano Di Girolano já falou (http://www.revistapsicologia.com.br/materias/pontoDeVista/erotismo_porno.htm). Das inconstitucionalidades do ECA não existe mais nada a acrescentar ao texto de Victor Hugo Pereira Gonçalves (http://www.juristas.com.br/informacao/revista-juristas/da-inconstitucionalidade-da-lei-da-pedofilia-infantil-na-internet/24/).

Foi a pornografia, e por extensão a pedofilia, que levaram os dois casais do Rio Grande do Sul à prisão e agora Rones na Paraíba. Estes fatos me fizeram lembrar de um trecho de uma comunicação da década de noventa:
Para Alexandrian, não há diferença entre pornografia e erotismo. "A pornografia é a descrição pura e simples dos prazeres carnais: o erotismo é essa mesma descrição revalorizada em função de uma idéia do amor ou da vida social. Tudo o que é erótico é necessariamente pornográfico, com alguma coisa a mais" (1993:8). A obscenidade, continua este Autor, "rebaixa a carne, associa a ela a sujeita, as doenças, as brincadeiras escatológicas, as palavras imundas" (Id. loc. cit.). Demostra-se, assim, a relatividade da pornografia, do erotismo e da obscenidade; a pornografia pode ser uma delas (pornografia, erotismo e obscenidade), como pode ser as três ao mesmo tempo, quando mostra o não-mostrável, diz o não-dizível e rompe o censurável; torna público o privado (v. Giddens, 1993). Pornografia também é todo material de estímulo sexual explícito. Este é o conceito utilizado pela Comissão (presidencial americana) de Obscenidade e Pornografia (cf. Malamuth & Donnerstein, 1984:XV), criada em 1968.
Um dos objetivos desta Comissão era "estudar o efeito da obscenidade e da pornografia sobre as pessoas, em especial sobre os menores, e suas relações com o crime e outros comportamentos antisociais" (Byrne & Kelley, 1984:1). A pornografia, ao expor imagens consideradas atentatórias ao pudor e à moralidade, passa a ser associada a crimes de estupros e outras formas de agressões do homem contra a mulher. Os dados, como vimos acima, mostram que estas formas de agressões nem sempre têm uma causa sexual.
Os conceitos de pornografia emitidos por Alberoni e por Alexandrian diferem do conceito da Comissão sobre Obscenidade e Pornografia, pois esta pretende torná-lo positivo, juridicamente operacional, definida através de demonstrações, referências, citações e atividades sexuais. Mesmo assim não perde sua relatividade, pois as classificações destes elementos distintivos da pornografia têm bases morais. Uma foto, um quadro, podem variar de algo neutro, até algo extremamente pornográfico. As cenas de novela que contém tramas de relacionamentos amorosos, por exemplo, têm sido considerada por uns extremamente pornográficas e por outros (quanto muito) eróticas.
A cumplicidade promíscua da pornografia com a moralidade torna difícil, então, determinar um limite conceitual do que seja pornografia. O mesmo acontece com a moralidade. O pano de fundo desta relação são as definições acerca de sexualidade herdada dos pensadores religiosos. Se por um lado, então, as pessoas se vêem cerceadas de informações acerca da sexualidade, por outro lado ela aflora em cada pessoa. Parece ser esta a maior contradição em nossa relação com o sexo: uma "ausência/presente" (Comunicação apresentada em 08 de novembro de 1996 no Simpósio: Comunicacion, Pornografia y Educacion Sexual, parte do VIII Congreso Latinoamericano de Sexologia y Educacion Sexual, realizado em Montevidéu, Uruguay, nos dias 8 a 11 de novembro de 1996).
Jonathan Wallace e Mark Mangan publicaram um livro Sex, Laws, and Cyberspace: freedom and censorship of the online revolution (New York: Henry Hold and Co., 1996) e logo na introdução há um descrição interessante na respeito dos censores voluntários nos correios associa a censura à mudança. A invenção da máquina fotográfica durante a Guerra Civil permitiu que fossem enviadas fotografias de mulheres nuas para a frente de batalha e isto deu origem à Postal Obscenity Law, aprovada pelo Congresso de 1873, ainda é utilizada para instaurar processos às pessoas acusadas de terem computadores com imagens consideradas pornográficas.
O noticiário do caso Rones há a soma de dois fatores: uma elite conservadora impedindo a secularização patrocinada pelas novas tecnologias que coloca em perigo a manutenção em suas mãos os poderes político e econômico.
A Primeira Emenda norte americana proíbe a censura. A nossa Constituição Federal também a proíbe. Lá há os censores voluntários que agem na sombra das leis infraconstitucionais e aqui no Brasil seguem-se os mesmos passos. Quem são eles? Lá são “um inspetor postal, um corretor da bolsa, um senador dos Estados Unidos, um membro subalterno de uma igreja, um agente do FBI, um estudante universitário” (Jonathan Wallace e Mark Mangan, p.xi). Aqui vemos um cantor de gospel, que é Senador, que se identifica como pastor. Requisitos para angariar novos censores voluntários. Agentes policiais, delegados, promotores, juízes, pressionados pela pressão aderem a estas campanhas.
Estas campanhas se fossem orientadas para o bem público seriam louváveis, mas ela são, na verdade, voltadas à manutenção de conceitos religiosos desassociados dos interesses sociais.
E quando isto acontece a injustiça se torna flagrante. E os estragos se tornam irreparáveis.

Será que este moralismo
exacerbado compensa vidas destruídas?
